Subscription Contract and General Conditions of Sports Management Leysin SA

I. Subscription Contract

  1. subscriptions

After having visited the sports centers’ installations and/or having taken note of the services offered within the framework of our infrastructures, the user declares to subscribe to a personal subscription with Gestion Sportive Leysin SA, hereafter GSL SA, giving him the right to the following services:

  • Establishment of a personal file including a photo. The member’s photo and contact information are mandatory in our management system.
  • Use of sports center facilities according to the type of membership during the validity period.
  • Use of sports center facilities according to opening hours.
  • The access card must be presented at the reception of the centers
  1. Membership card /sports

The sports center will issue a membership card to the subscriber. This card is nominative and non-transferable. In case of loss, it will be charged CHF 5.00. The specific case of the definitive takeover of the subscription by a third party is reserved (letter C).

  1. Termination of the subscription/lease

Gestion Sportive Leysin SA (GSL SA) reserves the right to terminate the present subscription, without prior notice, in case of non-payment and/or non-compliance with the general conditions of the sports centers.

Non-use of the services does not give any right to refunds or reductions.

In the event of long-term incapacity (pregnancy, accident, illness, etc.) certified by a doctor, military service or moving, the subscription may be temporarily interrupted, subject to presentation of official proof.

The period of interruption of the subscription may be carried over to the next season’s subscription, upon request and after study of the case by the GSL SA management, or reimbursed on a pro rata basis. In the event of a refund, an administrative fee may be applied.

If a person willing to take over the membership under the same conditions is presented and accepted by the management of the Leysin sports centers, the membership can be transferred to a third party on a permanent basis. Administrative fees may apply.

  1. Strong and applicable law

In case of dispute, the place of jurisdiction is Aigle.

2. General conditions for sports management Leysin

GSL SA offers services in the field of sports/leisure and health. A non-exhaustive list of services offered by the Leysin sports centers can be found on the website www.sportleysin.ch.

  1. Object

The present general conditions aim to define the relationship between GSL SA and its users1, clients and subscribers (hereafter, users). The general conditions are applicable to all users of the services provided by GSL SA. All users are automatically subject to these terms and conditions.

The subscription contract between GSL SA on the one hand and the subscriber on the other includes these general terms and conditions, which form an integral part thereof. Specific conditions for the subscription contract are defined in point 1 above.

  1. Respect for the premises/materials

The user declares that he/she complies with the rules and regulations applicable in the sports centers and in the services offered by the said centers, adheres to them without restriction or reservation and respects the following instructions:

  1. Check in at the reception desk and follow the instructions of the center’s staff
  2. Smoking is strictly prohibited inside the
  3. For lost and found items, please contact the reception.
  4. It is forbidden to consume alcoholic beverages and food on the infrastructures

The user declares that he/she is insured for civil liability, breakage and theft for any damage caused to our equipment.

A security deposit may be required as a guarantee such as an ID card, driver’s license or credit card, etc…

Sports Center of the Pool

  1. Indoor tennis: clean shoes with smooth soles (no black soles). Spectators may access the tennis courts with protective footwear only provided.
  2. Outdoor tennis: sweep the court after use. Suitable tennis shoes are
  3. Squash: clean shoes with smooth soles (no black soles).
  1. Climbing wall : the belaying is under the responsibility of the users, please respect the
    other users. A guide or a certified person (J&S, etc..) is mandatory for
    groups.
    2. Swimming pool: swimming shorts maximum mid-thigh tolerated, underwear under swimsuits
    baths are prohibited. Children under 10 years old must be accompanied by an adult.
    3. A set of rules for pool users is posted in the pool area.
    4. Turkish bath: forbidden to children under 8 years old, unaccompanied.
    5. Locker rooms: shoes are not allowed to enter; store them on the shelves provided for this purpose.
    This can be done outside or by hand to the lockers.
    6. Weight room: clean shoes, towels, children from 14 years old accompanied by a friend
    adult, individual from 16 years old.

Skating Rink Sports Center

  1. Gymnasiums and aerobics: clean shoes with smooth, non-marking soles
    (no black soles), put away the equipment after use, no access to the
    technical rooms. For handball players: it is forbidden to use natural pitch.
    2. Outdoor tennis: sweep the court after use. Wearing proper footwear is
    mandatory.
    3. Soccer field: use only on reservation, please report to the reception in
    all cases.
    4. Ice rink: no bottles allowed around the ice rink, no walking on the mats in
    with the skates, put the laces inside the skates and put them on the
    counter after use. Respect the different areas and users. Ex: public field hockey
    and public skating
    5. Curling: curling shoes are mandatory, put away stones and brooms after use.
    7. Climbing wall : the users are responsible for the belaying. A guide or a
    certified person (J&S, etc..) is mandatory for groups.
  1. Locker rooms

The user can use the individual lockers provided; the deposit is CHF 2. It is recalled that
to the user that the locker rooms are not subject to any specific surveillance. GSL SA declines any
responsibility in case of theft or loss of objects.
It is strictly forbidden to leave personal belongings inside the lockers after leaving
the sports center.

  1. Information and personal data
Unless required by law, the personal data of the users are treated confidentially. GSL SA reserves the right to use the data for statistical, scientific and marketing purposes. However, no photographs of users will be published without their prior consent.
We use the Flodesk information software. Your data are sent to the company Flodesk at during this process. Flodesk is not allowed to sell your data or use it for any other purpose purposes than to send out newsletters. Flodesk is a certified provider that has been chosen in accordance with data privacy requirements.
Authorization for storage of data, e-mail address, and their use for sending the newsletter can be revoked at any time via the link « Unsubscribe « in the newsletter.
Measures concerning data protection laws are subject to technologies in constantly evolving, that’s why we ask you to inform yourself regularly about our data protection measures by consulting our privacy policies.
Any person attending the sports centers of Leysin consents to the publication of his photo on our different networks. The holder does not waive his right, but authorizes simply the publication. A request can be made to our management if you do not wish to not be photographed.
  1. Closing
In the case of the obligation to close certain sports facilities due to technical problems/maintenance, no extension of the subscription or compensation in in favor of the subscriber will be granted. Beyond a 40-day closure period, a request to the direction can be made.

Attests to being in good physical condition and not suffering from any medical condition (or other) that would prevent him/her from safely engaging in the type of activity for which he/she has engaged with GSL SA or be authorized by a recognized physician, in the context of a specific program adapted to his pathology, to attend the sports center.
  3. Recognizes that his/her health and safety is his/her own responsibility.
  4. Must be aware of their training possibilities and abilities or follow the prescriptions medical information about him. In case of doubt, the user must perform a medical check-up certifying his capacity to follow an intensive physical activity or at least adapted to his pathology; this document may be requested.
  1. Responsibility
The sports centers at the pool and the skating rink provide equipment and facilities that are regularly maintained.
  • User:
  • Acknowledges awareness of the risks and hazards associated with physical exercise.
  • Formally and irrevocably waives the right to raise claims against GSL SA in the event of of accidents, regardless of their cause.
  • Must be personally insured against accidents. GSL SA declines all responsibility in the event of accident, injury or illness not resulting from a legal obligation from him.
  • Fully accepts and assumes all risks and dangers and agrees not to pursue GSL SA, its directors, employees and instructors from any liability regarding injuries, losses and damages, whether on or off the premises of the centers sports and which do not result from a legal obligation of GSL SA.
  • GSL SA declines all responsibility in case of litigation, theft and accident on the premises of the service
  1. Minor user
When the user is under 18 years old, the use of the services of the sports centers is carried out with the agreement and under the full responsibility of the holders of parental authority. These are the guarantors the user’s compliance with these general conditions.
  1. Special rates
The application of special rates: student, AI, member, … is subject to the examination of the reasons of the grant (i.e. student card, AI, member, …). In case of subscription renewal, any discounts or other special conditions previously granted may be null and void.
  1. Terms of payment
The total amount of the contract or subscription is due, whether it is a global payment or by monthly payment (in agreement with the management). The same applies to any subsequent renewal of the contract or subscription. All amounts can be paid by cash, credit card or invoice. Patches can be paid for and reserved directly on our website www.sportleysin.ch.
  1. Cancellation conditions

In case of cancellation, the following will be retained:

  • More than three months before the date of the stay: 30% of the estimated total
  • From three to two months before the date of the stay: 50% of the estimated total
  • Less than two months before the date of the stay: 70% of the estimated total
  • Less than one month before the date of stay: 80% of the estimated total
  • Less than one week before the date of stay: 100% of the estimated total
Figure skating:
Patches are subject to change if no entries are noted. This is why it is important to register directly on our website. Cancellation fees are 100% if the cancellation is made less than 48 hours before the start of the patch
  1. Modification

GSL SA has the right to modify, at any time, its rates, regulations, general conditions and other contractual documents. Changes are communicated by posting in the Sports Centers.

3. Group courses

The subscription gives access to the group classes.

  1. Subscriptions

The subscription contract is nominative. Under no circumstances may it be shared with a third party.

  1. Age-related conditions

The member certifies to be at least 18 years old. For 16 & 17 year olds, exceptions are made with a signed parental agreement.

  1. Regulation
The participant must adhere without restriction or reservation to the rules of safety and hygiene. He agrees to respect the following instructions:
  • Wear specific sports clothing and shoes and
  • Use a towel on the equipment and clean up after yourself and your equipment
  • Adopt a pleasant and respectful behaviour towards other members and staff of Gestion Sportive Leysin SA.
  1. Cancellation

For any participation in the group classes, it is essential to register by phone or email because the material needed for some of the courses offered by Gestion Sportive Leysin is limited.

If Gestion Sportive Leysin has to cancel a group class, the registered participants will be contacted by phone.
